Terms & Conditions

1.Stoke Collective

STOKE COLLECTIVE reserves the right to remove these packages at any time, whilst honouring any contract we have with an existing member. This is a membership commencing on the day of purchase. It will automatically renew after each period of the membership until you notify us of your intention to terminate your membership. There is a 28-day cancellation notice period on all direct debit memberships.

2. Cooling Off Period

You can cancel your membership with us up to 7 days from the date of the agreement. This is only applicable to new membership agreements. If you cancel within the 7-day cooling-off period, we will refund your money less any set-up fee or the value of any promotional item we have given you upon joining with us.

3. Minimum Age

The minimum age for training with us is 16. People under the age of 18 are required to have their parents or legal guardian sign these terms and conditions.

4. Your Health

You warrant that you are in good physical condition and you know of no medical or other reason why you cannot or should not do active or passive exercise. You recognise that the fitness coach(s) is not able to provide you with medical advice about your fitness and that this information is used as a guideline to the limitations of your ability to exercise. You agree to not hold any certified trainer or directors of STOKE COLLECTIVE liable for any injury or illness that may occur during a session. You understand that should you feel light-headed, faint, dizzy, nauseated, or experience pain or discomfort, you are to stop the activity and inform your coach(s) immediately.
You must not attend STOKE COLLECTIVE if you are experiencing flu-like symptoms.

5. Paying For Memberships

Membership fees are paid weekly by direct debit from a bank account or credit card.

6. Meeting Your Responsibilities

You must make sure:

  • your account can accept direct debits

  • there is enough money in your account on the payment day and the next 5 days

  • you tell us if you are transferring or closing your account, at least 72 hours before the next direct debit

  • you tell us about any changes to your credit card, such as its expiry date or number, at least 72 hours before your next debit.

7. What Happens if Your Payment is Late or Fails

If you do not pay your fees on the due date, we will suspend your access to STOKE COLLECTIVE until any outstanding balance has been paid and you have given us your account details. We will continue to debit your nominated account without notice until we have received the total amount you owe. STOKE COLLECTIVE will make a reasonable effort to let you know beforehand by:

  • phoning you, texting you or speaking to you at the studio

  • writing to the email address you last gave us. For membership/s in your name, you must make sure that the payment method you choose remains valid for the length of your agreement. This includes third-party accounts.

  • If the details you give us fail, you are liable for all resulting fees.

8. Can We Change Your Agreement?

We may sometimes add to, change, or remove our terms and conditions. This includes changing a studio’s opening and closing hours, its services and facilities, and membership fees. Sometimes, we may also close studios for refurbishment to improve their facilities. If this substantially reduces our ability to provide our service to you, we will reduce your membership fees accordingly on a pro-rata basis. The most up-to-date terms and conditions always apply. We will give you at least 28 days’ notice of any changes. If we do not fulfil our obligations to you, you may be able to cancel your membership. Unless the law states, otherwise, you will not have any other claim against STOKE COLLECTIVE if this happens.

9. Can We Increase Your Fees?

We will not increase your fees during your initial 4-week term. We reserve the right to increase your fees at any time following the expiry of your initial term. We reserve the right to increase the fees of our memberships at any time. We will make a reasonable effort to tell you about this at least 28 days beforehand by writing to the address you last gave us (which may be an email address). We will consider that you have received our letter or email on the second business day after it is sent. Where we have made a reasonable effort to let you know about a fee increase, you authorise us to increase any debits from your nominated account.

10. Suspensions & Cancellations

We understand that from time to time you may not be able to train due to holidays, rest periods, becoming sick or injured, or wish to cancel your membership altogether. The following rules apply to suspensions and cancellations:

SUSPENSIONS;
Memberships can be suspended at any time. You must give 5 business days written notice to hello@stoke-collective.com or via the suspension form on our website. The following limits apply to each membership.
The STOKE COLLECTIVE studio manager reserves the right to authorise or decline any suspension request if they believe it does not meet the studio requirements.
The maximum suspension period is 4-weeks per year unless approved by the studio manager. This may incur a $10 per week fee.

Suspensions extend the minimum term period to a period equal to the suspension. You understand that the minimum term represents 26 payments of the membership amount.

CANCELLATIONS;
Following your contracted term, your membership may be cancelled by giving 28 days’ notice in writing to the email address hello@stoke-collective.com or via the suspension form on our website.

11. Upfront Memberships

Paid in full memberships are strictly non- refundable after the cooling off period, however, you may transfer the remaining term of your package to a friend or family member (transfer fees of $50 are applicable and the incoming member must meet the minimum requirements mentioned above.)

12. Session Packages

10-pass pack which expires after 12 weeks from the date of purchase. All other pass packs note their specific expiry period.

13. Use Of Your Image

You agree to allow STOKE COLLECTIVE to take a video or photo to use for promotional purposes from time to time.

14. Personal Belongings

You agree that STOKE COLLECTIVE is not responsible for any loss or damage to personal belongings. It is advised not to leave valuables unattended whilst attending a session.

15. Conditions Of Entry To The Studio

All sessions must be pre-booked. Entry will be refused to a session if a member has not booked and the session is full. All members must cancel their bookings if they decide not to attend a session. Appropriate workout attire and footwear must always be worn. All participants must have a towel. Workwear is not acceptable. Offensive slogans on clothing are not acceptable. If a trainer deems a member to be under the influence of drugs or alcohol, entry to a session will be denied. Anti-social behaviour will not be tolerated, and members will be asked to leave the session solely at the discretion of the coach. STOKE COLLECTIVE reserves the right to cancel a membership for any unacceptable behaviour. If at any time a coach advises you to stop a session for your own physical safety, then their decision is final. All liability for your wellbeing is placed on yourself.

*NB: FAILURE TO CANCEL YOUR BOOKING IN A SESSION THAT YOU DO NOT ATTEND WILL ATTRACT A FEE OF $20. THIS WILL BE DEDUCTED AUTOMATICALLY. IF YOU CANCEL YOUR BOOKING WITHIN 12 HOURS OF THE SESSION TIME A LATE CANCELLATION FEE OF $20 WILL BE CHARGED. IF YOU PURCHASE PACK OPTION A FEE WILL NOT BE CHARGED HOWEVER THAT SESSION WILL NOT BE REFUNDED OR REALLOCATED.

16. Risk

You understand that sessions at STOKE COLLECTIVE may be physically strenuous and you voluntarily participate in them with full knowledge that there is risk of personal injury, property loss, or death. You agree that neither you, your heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against STOKE COLLECTIVE or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.

17. Creche Services

STOKE COLLECTIVE operates unlicensed creche facilities, which in order to provide safe and affordable child minding services for all members, are exempt from the Education and Care Services National Regulations 2012. The creche is excluded from the meaning of Child Care and is not subjected to the Children and Community Services Act 2004.

  • For creches to be excluded from licensing requirements, parents must remain on the premises, nearby and able to attend to their children’s immediate physical needs, such as comforting, feeding or nappy changes if required/requested by the STOKE COLLECTIVE staff.

  • I accept that I must stay on the premises and within close proximity of the creche while my child attends.

  • I understand that I am not to bring my child into the creche if he/she is unwell.

  • I understand that the Parent/Guardian who signs a child into the creche, MUST be the same Parent/ Guardian to pick up and sign out.

  • I understand that I am at all times responsible for my child/children while he/she attends the creche.

  • I understand that I must immediately return to the creche to attend to my child should I be requested to do so by creche staff.

  • I give consent to medical treatment being administered for my child in an emergency.

  • I declare that I will notify the creche staff of any changes to my child's circumstances.

  • I understand children are only accepted into the creche from 12 weeks of age.

  • I accept that although every care will be taken, creche Staff are free from all responsibility for accidents or loss of property in connection with any child’s participation.

STOKE COLLECTIVE reserves the right to exclude child/children from the creche for misbehaviour that is deemed inappropriate.

STOKE COLLECTIVE reserves the right to refuse any child or person entry to the creche.
